1. About these Terms
These Terms of Use apply when you access or use WELOWR. By using the service, you agree to comply with these Terms and any applicable laws.
2. About WELOWR
WELOWR is operated by GC Soft Technology Pty Ltd in Australia. WELOWR provides technology and information designed to help consumers compare prices, monitor buying opportunities and, where available, combine purchasing interest through Buyer Groups.
3. Nature of the service
WELOWR may provide product information, retailer prices, price histories, deal information, Target Price tools, notifications, Buyer Groups and retailer offers. Features may change as the service develops.
4. WELOWR is not necessarily the seller
Unless WELOWR expressly identifies itself as the seller in a particular transaction, products displayed through the service are supplied or sold by independent third-party retailers.
The identity of the seller and the applicable transaction terms should be reviewed before completing any purchase.
5. Product information
Product names, descriptions, images, specifications and other product information may originate from retailers, manufacturers, permitted data sources or other third-party sources.
We seek to provide useful information, but product details should be confirmed with the retailer before purchase where they are important to your decision.
6. Prices and availability
Retail prices, stock availability, shipping charges, discounts and promotions may change without notice. A price displayed by WELOWR may therefore differ from the price shown by a retailer at the time you complete a transaction.
7. Price comparison
WELOWR may compare offers from multiple retailers to help users evaluate purchasing options. The presence or ordering of an offer does not necessarily mean that it is the best option for every user.
Factors such as delivery cost, location, availability, warranty, retailer terms and personal preferences may affect the overall value of an offer.
8. Price history
Historical pricing information is provided as a shopping aid. Past prices do not guarantee future prices and should not be interpreted as a prediction that a product will increase or decrease in price.
9. Deal indicators and recommendations
Any deal score, price indicator, buying signal, recommendation or similar feature generated by WELOWR is provided for general shopping assistance only.
It is not financial advice, a guarantee of savings or a guarantee that the same or a better price will not become available later.
10. Watchlists and price tracking
Users may be able to follow products or request notifications about relevant price changes. Tracking depends on the information available to WELOWR and may not capture every price change immediately.
11. Target Prices
A Target Price allows you to indicate the price at which you would have stronger interest in purchasing a product. Creating a Target Price does not constitute an order, purchase or binding promise to buy.
WELOWR may notify you when relevant tracked pricing reaches or falls below your Target Price.
12. Buyer Groups
Buyer Groups are designed to combine genuine purchasing interest from users interested in the same product. The purpose is to provide a clearer indication of potential group demand and, where appropriate, create an opportunity for retailers to respond.
13. Joining a Buyer Group
Joining a Buyer Group expresses purchasing interest but, unless clearly stated otherwise during a later transaction, does not itself create a legally binding obligation to purchase.
Users should provide genuine quantities, target prices and other information when participating in Buyer Groups.
14. Buyer Group qualification
WELOWR may use factors such as participant numbers, quantities, target prices, current reference prices, location, freshness of interest and potential order value when assessing a Buyer Group.
Qualification does not guarantee that a retailer will make an offer or that an offer will meet every member's target.
15. Retailer offers
Retailers may be invited or permitted to submit offers in response to Buyer Group demand. Offers may contain conditions relating to price, quantity, stock, delivery, location, expiry or other commercial terms.
16. Offer ranking and selection
WELOWR may display, rank, shortlist or otherwise organise retailer offers using price and other relevant factors. Such ranking is intended to assist users and does not constitute a warranty or endorsement of a retailer.
17. Formation of a purchase contract
A purchase contract is formed only through the applicable checkout, order acceptance or other transaction process. A Target Price, Buyer Group membership or receipt of an offer does not by itself create a completed purchase.
18. Third-party checkout
Some transactions may be completed on a retailer's website or through another third-party service. In those cases, the third party's terms, privacy practices and transaction processes may apply.
19. Payment
Where payment is processed by a third-party retailer or payment provider, WELOWR may not receive or store complete payment-card details. Users should review the payment terms presented during checkout.
20. Shipping and delivery
Shipping costs, delivery areas, delivery estimates and fulfilment obligations may be determined by the relevant retailer. Delivery estimates are not guarantees unless expressly stated by the responsible seller.
21. Returns, refunds and warranties
Where a product is sold by a third-party retailer, returns, refunds, repairs, replacements and warranty claims may be handled by that retailer, subject to applicable law and the retailer's terms.
22. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including rights that may apply under the Australian Consumer Law.
23. User accounts
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.
You should notify WELOWR promptly if you believe your account has been accessed without authorisation.
24. Accurate and genuine information
Information submitted through WELOWR should be accurate and genuine. Users must not intentionally create false demand, artificial Buyer Group participation, misleading Target Prices or fraudulent activity.
25. Acceptable use
You must not:
- use WELOWR for unlawful or fraudulent purposes;
- attempt unauthorised access to systems or accounts;
- interfere with the security or operation of the service;
- introduce malicious software or harmful code;
- circumvent access controls or security measures;
- misuse automated systems in a way that harms the service;
- impersonate another person or organisation.
26. Intellectual property
WELOWR software, branding, interface design and original content are owned by or licensed to GC Soft Technology Pty Ltd unless otherwise stated.
Third-party product names, logos and trademarks remain the property of their respective owners.
27. Third-party websites and services
WELOWR may contain links to external websites or services. We do not control third-party websites and are not responsible for their availability, security, content or practices.
28. Service availability
We aim to provide a reliable service but cannot guarantee continuous or uninterrupted availability. Maintenance, security incidents, infrastructure failures or circumstances outside our reasonable control may affect access.
29. Changes to WELOWR
We may add, modify, suspend or discontinue features where reasonably necessary for technical, security, operational, legal or commercial reasons.
30. Suspension or termination
We may restrict or suspend access where we reasonably believe there has been fraud, abuse, unlawful conduct, a security risk or a material breach of these Terms.
31. Limitation of liability
To the extent permitted by law, WELOWR does not accept liability for loss arising solely from inaccurate, unavailable or outdated third-party product, retailer, pricing or stock information.
Nothing in these Terms limits liability or rights where such a limitation is prohibited by applicable law.
32. Privacy
Our handling of personal information is described in the WELOWR Privacy Policy.
33. Changes to these Terms
We may update these Terms as WELOWR, applicable law or our business practices change. The current version will be published on this page with an updated revision date.
34. Governing law
These Terms are governed by the applicable laws of Australia and the relevant Australian jurisdiction, subject to any mandatory rights or protections that apply to you.
